Making arrangements for children post separation can be a particularly difficult time for parents and children alike. If agreement is not able to be reached between you and your partner, we will provide you with advice as to how to move forward, including acting for you in court proceedings, if this is necessary.

Mediation

Mediations are an important step in making decisions about parenting arrangements. We can provide you with advice about what a mediation is and make suggestions regarding engaging a mediator. Often, parents attend a mediation without solicitors early in the process. If agreement is reached, the mediator may prepare a Parenting Plan or may recommend you have a solicitor draft a document for you. We are happy to assist in this process.

Where agreement is not reached in this way, a mediation can be conducted with solicitors and we will act for you in this process. 


Parenting Plan

A Parenting Plan is a document which can be entered to formalise an agreement reached in relation to parenting arrangements. A Parenting Plan is not legally binding but can be produced as evidence in court proceedings.  A Parenting Plan can be flexible and can provide for reviews. This is helpful when children are young, or shortly after separation, allowing for time to pass before finalising arrangements.


 Court Orders

Court Orders can be obtained, by consent, if you reach agreement regarding parenting arrangements. Orders made by the court are enforceable and provide certainty. They remain in place until the children turn 18.

If agreement cannot be reached, an application can be made to the court for orders. We will draft the necessary documents and strongly advocate for you. We will present your case in a clear and effective manner and will provide you with open communication throughout the process.
